Privacy Policy

This document (the “Policy”) sets out the rules governing Users’ use of the website https://shkrebets.com, and the procedure by which the Attorneys’ Association collects, stores, uses, and protects Users’ personal data.

1. Definitions.

1.1. Attorneys’ Association (Website Owner, Controller) means the legal entity Attorneys’ Association “Shkrebets and Partners” (USREOU code 38631544; registered address: 14 Kaplunivskyi Lane, Kharkiv, 61002, Ukraine), which holds all rights in the Website;

1.2. Attorneys of the Attorneys’ Association means attorneys who, according to the Unified Register of Attorneys of Ukraine, are members (founders or participants) and practice law in the organizational and legal form of the Attorneys’ Association;

1.3. Associated partners of the Attorneys’ Association means lawyers, attorneys, auditors, insolvency practitioners, appraisers, experts, and other independent legal specialists, including persons engaged in independent professional activity (including foreign persons), who are not members (founders or participants) of the Attorneys’ Association or persons related to it, and who are specifically engaged to provide particular elements of legal assistance on certain projects and/or in certain areas. Associated partners who are lawyers, auditors, insolvency practitioners, appraisers, experts, or other legal specialists, or persons engaged in independent professional activity, do not belong to the Attorneys’ Association and carry on their activity in separate, independent organizational forms, provided for by applicable law, that are not connected with it. Associated partners who are attorneys do not belong to the Attorneys’ Association and practice law in separate, independent organizational forms of legal practice that are not connected with it (individually, through an attorney’s office or an attorneys’ association, or otherwise);

1.4. Website means the set of web pages available on the Internet at https://shkrebets.com;

1.5. User means any individual or legal entity that accesses the Website via the Internet;

1.6. Personal Data means any information, or set of information, about an individual (the User) who is identified or can be specifically identified;

1.7. Processing of Personal Data means any operation or set of operations, such as collection, registration, accumulation, storage, adaptation, alteration, renewal, use, and dissemination (distribution, sale, transfer), depersonalization, and destruction of Personal Data;

1.8. Cookies means small text files stored on the User’s device during a visit to a website and containing information about the User’s online activity;

1.9. Marketing communications means electronic messages containing information about the services, news, and offers of the Attorneys’ Association;

1.10. Selected cases (selected matters from legal practice) means individual matters handled by the Attorneys of the Attorneys’ Association, by Associated partners of the Attorneys’ Association, or by other legal specialists (lawyers, attorneys, auditors, and insolvency practitioners) engaged to provide legal assistance to clients, as published on the Website, together with news items and information notices about such matters published on third-party pages (resources) on the Internet, which illustrate experience and legal expertise in the service areas presented on the Website.

1.11. Other terms are used with the meanings given to them by the applicable legislation of Ukraine.

2. General provisions.

2.1. This Policy has been prepared in accordance with the Law of Ukraine “On Personal Data Protection”, the Law of Ukraine “On the Bar and Practice of Law”, the General Data Protection Regulation 2016/679 (GDPR), and other applicable rules of law.

3. Terms of use of the Website.

3.1. All intellectual property rights in the content of the Website, including but not limited to design elements, software code, texts, analytical articles, photographs, illustrations, graphic images, logos and trademarks, and descriptions of selected matters from the legal practice of the Attorneys’ Association, of Associated partners of the Attorneys’ Association, or of other legal specialists (lawyers, attorneys, auditors, and insolvency practitioners) engaged to provide legal assistance to clients, belong exclusively to the Attorneys’ Association or are used by it on lawful grounds.

3.2. Any copying, reproduction, quotation, publication, distribution, or other use of materials from the Website, whether for commercial or non-commercial purposes, is prohibited without the prior written permission of the Website Owner.

3.3. All information, analytical materials, articles, commentaries on legislation, and other publications placed on the Website are provided for general information only. They do not constitute professional legal, tax, or other professional advice and cannot replace an individual consultation with an attorney. Visiting the Website, reading its materials, or submitting a request through the contact forms does not create an attorney-client relationship.

3.4. The Website Owner accepts no liability for any direct, indirect, or incidental loss, lost profits, or any other adverse consequences arising from the use of, or inability to use, the Website, or from any decision the User takes on the basis of information published on the Website. The User relies on information from the Website entirely at the User’s own risk.

3.5. The Attorneys’ Association treats Users’ confidential information with care and undertakes to observe attorney confidentiality in respect of information that falls within that definition under the law.

3.6. By leaving contact details (an email address or a telephone number) in the feedback forms, the User agrees to receive electronic messages of an informational and marketing nature from the Attorneys’ Association (company news, legal digests, invitations to events, and similar communications). The User may refuse such communications at any time by clicking the relevant link (the “Unsubscribe” button) in the message or by sending the Attorneys’ Association a separate request to office@shkrebets.com.

4. Collection of Personal Data.

4.1. The Attorneys’ Association collects only Personal Data that the User provides knowingly and voluntarily (for example, when completing feedback forms, subscribing to a mailing, or sending an email).

4.2. Such Personal Data of the User may include:

  1. identification and contact data: first name, last name, email address, telephone number, address, taxpayer registration card number, and similar data (provided by Users when submitting electronic requests or registering);

  2. technical data: IP address, browser type and version, time-zone setting, operating system, and device information;

  3. usage data: information about how you use the Website, the pages viewed, and the time spent on the site (collected automatically by means of Cookies).

5. Storage of Personal Data.

5.1. The Attorneys’ Association applies the principle of minimization of Users’ Personal Data and stores and processes only the minimum amount of Personal Data that is strictly necessary for the particular purpose.

5.2. Users’ Personal Data is stored on secured servers, using current technical and organizational security measures that prevent unauthorized access to, alteration, disclosure, or destruction of the data.

5.3. The Controller stores Personal Data for the period necessary to achieve the purposes stated in this Policy, or for the period established by the applicable legislation of Ukraine, whichever is longer.

5.4. Associated partners of the Attorneys’ Association store Personal Data in compliance with the safeguards provided by this Policy, subject to the User’s explicit written consent, and solely for the purpose of carrying out the client’s instructions (the provision of legal assistance) and of providing particular elements of legal assistance on certain projects and/or in certain areas.

6. Use of Personal Data.

6.1. The Attorneys’ Association uses Personal Data in order to identify Users and to carry out their instructions as clients, to provide legal assistance and related legal or other services, and to perform the duties and functions prescribed by law. Personal Data collected from Users may also be used by the Attorneys’ Association for the following purposes:

  1. processing Users’ requests and providing a response;

  2. arranging meetings or providing preliminary consultations;

  3. sending legal digests and marketing materials (where consent has been given);

  4. analyzing and improving the performance of the Website.

6.2. The Attorneys’ Association does not transfer, sell, or disclose Personal Data to third parties, except where the legislation of Ukraine expressly so requires, or where the User’s explicit written consent has been obtained. Information constituting attorney confidentiality is protected in accordance with the Law of Ukraine “On the Bar and Practice of Law”.

6.3. Associated partners of the Attorneys’ Association use Personal Data in compliance with the safeguards provided by this Policy, subject to the User’s explicit written consent, and solely for the purpose of carrying out the client’s instructions (the provision of legal assistance) and of providing particular elements of legal assistance on certain projects and/or in certain areas.

6.4. Because international analytics and cloud services are used, Users’ Personal Data may be transferred to and stored on servers located outside Ukraine (in particular, in countries of the European Union or in the United States). The Attorneys’ Association takes every available measure to ensure that any such cross-border transfer of Personal Data is carried out in accordance with applicable law and with an adequate level of data protection.

6.5. The Attorneys’ Association takes appropriate measures to configure the interfaces of the Website and of the applications used to provide services so as to maintain the highest practicable level of confidentiality.

7. Cookies.

7.1. The Website uses Cookies to ensure that the site functions correctly, to analyze traffic, and to personalize the user experience.

7.2. The Website uses both session (temporary) Cookies and persistent Cookies.

7.3. The User may set the web browser to reject all Cookies or to notify the User when Cookies are sent. Disabling Cookies may, however, cause certain features of the Website to display incorrectly or to become unavailable.

8. Use of analytics tools (Google Analytics).

8.1. The Website uses the Google Analytics web analytics service. It uses Cookies to analyze Users’ interaction with the Website. The information generated (including the IP address) is transmitted to and stored on Google servers for the purpose of compiling activity reports.

8.2. The User may opt out of collection of data by Google Analytics by installing the Google Analytics Opt-out Browser Add-on.

9. Use of marketing tools (Facebook/Meta Pixel).

9.1. A Facebook Pixel code fragment may be installed on the Website. It allows Users’ actions to be tracked after they arrive from advertising on Facebook or Instagram, for the purpose of assessing its effectiveness and of retargeting.

9.2. Such Personal Data is anonymous as far as the Attorneys’ Association is concerned, but it is processed by Meta, which may associate it with your social-network account. The User may manage advertising settings in their Facebook or Instagram profile, in the “Ad settings” section.

10. Rights of the User as a Personal Data subject

10.1. Under the legislation of Ukraine and this Policy, the User has the right:

  1. to know the sources from which their Personal Data is collected, the location of their Personal Data, and the purpose of its processing by the Controller, and to obtain access to their Personal Data;

  2. to require inaccurate or outdated Personal Data to be rectified;

  3. to require erasure of their Personal Data (the “right to be forgotten”) where it is no longer necessary for the purposes for which it was collected, or where consent is withdrawn;

  4. to withdraw, at any time, the consent given to the Controller for the processing of Personal Data;

  5. to object to the processing of their Personal Data for direct marketing purposes.

10.2. On any matter concerning the exercise of these rights, the User may contact the Attorneys’ Association by sending a request to office@shkrebets.com.

11.1. For Users’ convenience, the Website may contain links to other internet resources (for example, state registers, social networks, and websites).

11.2. This Policy does not apply to such third-party resources. The Attorneys’ Association is not responsible for the content of third-party websites, or for compliance by those third parties with the rules on the processing of Personal Data.

12.1. By using this Website, the User confirms that the User has read this Policy, understands its contents, and gives irrevocable consent to all of its terms.

12.2. If the User does not agree with any provision of this Policy, the User must immediately cease using the Website.

13. Amendments and additions to the Policy.

13.1. The Attorneys’ Association reserves the right to amend and supplement this Policy at any time, without prior personal notice to Users.

13.2. All amendments take effect upon publication of the new version of the Policy on the Website. Continued use of the Website after amendments have been made means that the User automatically agrees to the updated Policy.
