Sergiy Mufazalov, an attorney of Shkrebets & Partners, has successfully defended the client in a criminal case on charges of committing criminal offenses under Art. 296 Part 2, Art. 296 part 4 of the Criminal Code of Ukraine. As a result of the work of the Partnership, the client was found not guilty and acquitted due to the lack of proof of his criminal offense. In particular, the court concluded that the fact that our client was at the scene of the crime was not proven, and the evidence of the prosecution is not proper and admissible. Congratulations to the criminal law team of Shkrebets&Partners, in particular, Ruslan Bekuzarov, with confirmation of the acquittal in the Supreme Court. The decision of the Supreme Court of 16.06.2021 in case № 642/957/17 left the acquittal of the Leninsky District Court of Kharkiv of 03.11.2018 and the decision of the Kharkiv Court of Appeal of 17.11.2020 unchanged. The client was acquitted under Part 1 of Art. 368 of the Criminal Code of Ukraine in connection with the lack of proof and under Part 1 of Art. 190 of the Criminal Code of Ukraine in connection with the absence in the actions of the client of a criminal offense. Shkrebets& Partners is a partner of the IX International Judicial and Legal Forum, which is held annually by the publishing house Yuridicheskaya Practika. The third session of the forum was moderated by Anton Novakov, a partner of the Partnership. Experts discussed the practice of conciliation in criminal proceedings, representatives of the judiciary spoke about the formation of the WACS practice in anti-corruption criminal proceedings and the practice of reviewing the verdicts of the court of first instance, analyzed the “precedent” decisions of the HCC. Partners of law firms, in turn, drew attention to the excessive length of criminal proceedings and ways to overcome this phenomenon. Experts stressed how criminal cases can be made faster and better. Summing up the discussion, the moderator noted that his personal experience with the new CPC of Ukraine shows that out of one hundred percent of petitions that were not accepted by the prosecutor and the court of first instance, ninety percent were granted by the Supreme Court.
