Maksym Shypenko, an attorney of AP “Shkrebets&Partners”, has successfully defended a client in the case of corruption.
The official of National Law University named by Yaroslav the Wise was drafted by a “corruption protocol” under Part 2 of Art. 172-6 KUPAP (untimely notification of significant changes in property status). The key in this case was the issue of correctly setting the date of ownership of a customer for a car purchased abroad.
The national police authority considered that the declaring entity should have informed the National Anti-Corruption Agency about the purchase of the car abroad within 10 days from the date of payment for it by invoice, which testified to the transfer of such a car, which the court of the first instance agreed with, finding the client guilty of an offense.
The Court of Appeal, closing the proceedings in the absence of an event and the composition of the offense, recognized the substantiated position of the defense party that the notification of significant changes in the property condition, in the case of buying a car abroad should be submitted within 10 days from the moment of state registration of the car and the ruling it is registered with the competent authorities of Ukraine, since it is from the moment of state registration of the car that the person acquires the ownership right to it.
